Please carefully review these Terms of Service (“Agreement”) as they establish a legally binding contract between you and Bad Ass Marketing Funnels N Films (“BAMFNF,” “we,” “us,” or “our”). By accessing or using our website, platform, and any information or services provided through them (collectively, the “Services”), you consent to be bound by this Agreement.
BY USING OR ACCESSING THE SERVICES, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. YOU ALSO ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD OUR DATA PRACTICES AS DESCRIBED IN OUR PRIVACY POLICY APPLICABLE TO THE SERVICES.
Objective
BAMFNF provides sales, marketing, automation, and related services, which may include software platforms, white-label offerings, agency services, consulting, training, templates, workflows, automations, and other related tools.
By using our website, platforms, and Services, you agree to comply with this Agreement and any other policies or guidelines incorporated by reference. The effectiveness of the Services is subject to your adherence to these terms.
Eligibility
By using the Services in any manner, you represent that:
You have read, understood, and agree to be bound by this Agreement, including any future modifications and additions that may be issued periodically and made available through our website or via the Services;
You are at least 16 years old;
You have the authority to enter into this Agreement on your own behalf or on behalf of a business entity you represent; and
You will comply with all applicable laws and regulations while using the Services.
If you do not agree to these Terms, you are not permitted to access or use the Services.
Access
Subject to your compliance with these Terms, BAMFNF grants you a non-exclusive, revocable, limited license to use the Services.
We reserve the right, in our sole discretion, to modify, suspend, or terminate any portion of the Services and/or your access, with or without notice.
You agree to safeguard your login credentials and not disclose your username or password. You are solely responsible for all activity occurring under your account. If you believe your account has been compromised, you must notify us promptly.
BAMFNF is not responsible for unauthorized access or use of your account caused by your failure to protect your credentials.
Acceptable Use Policy
By using the Services, you agree that you will not:
Use the Services for unlawful purposes or engage in deceptive or fraudulent activity;
Provide false, inaccurate, or misleading information;
Harm, disable, overload, or impair our servers or networks;
Attempt unauthorized access to any part of the Services or related systems;
Fail to report errors, bugs, unauthorized access methods, or intellectual property violations you discover;
Submit content that violates laws relating to minors, exploitation, harassment, or other unlawful activity;
Violate state or federal electronic advertising regulations, if applicable;
Infringe third-party intellectual property or proprietary rights;
Violate third-party licenses related to your content; or
Make statements (written or oral) that are defamatory, slanderous, or libelous about BAMFNF or any related party.
Information About Our Services
We strive to provide accurate information, but we do not guarantee absolute accuracy, adequacy, quality, or suitability. We disclaim liability for errors or omissions in content. Your reliance on any content made available through the Services is at your own risk.
Links to third-party websites or phone numbers do not imply endorsement or affiliation.
Payment Terms
By agreeing to these Terms, you authorize BAMFNF to charge your designated payment method in advance for subscription fees and/or selected Services (the “Subscription Fees”) for each billing term of your plan.
Fee Changes: BAMFNF may adjust Subscription Fees after providing at least ten (10) days advance notice via email to the email address you provide.
Non-Refundable: Subscription Fees and any applicable communication surcharges are non-refundable.
Additional Fees: Certain Services may require fees not included in your subscription.
Communications Surcharges: You are responsible for communications-related fees associated with your use of the platform, including carrier or provider charges where applicable.
Taxes: All fees are in U.S. Dollars and exclusive of applicable taxes; you are responsible for taxes and other expenses.
If payment is not received when due, we may suspend or terminate access. If your payment method expires or is declined, we may suspend Services without notice.
Payment processing may involve third-party providers and is governed by their terms. Review those third-party terms before purchasing.
Subscription Terms, Renewals, and Cancellation
Subscriptions are generally billed monthly or annually unless otherwise stated.
Your subscription will automatically renew for successive renewal terms identical to your initial term unless canceled by you or BAMFNF in accordance with these Terms.
To avoid charges for the next billing cycle, you must request cancellation at least thirty (30) days prior to the start of your next billing cycle.
Upon cancellation by either party:
You remain responsible for fees owed through the end of the current billing term;
Partial billing periods are non-refundable unless explicitly stated in a promotional offer;
You may retain access until the end of your current billing period;
After that, your account may be archived and may become read-only.
Done-For-You services: If you subscribe to any “Done For You” service, the minimum commitment is three (3) months unless otherwise agreed in writing.
How to Cancel
You may request cancellation through:
Coordinating with our support team through the chat function (if available), or
Emailing billing@bamfnf.com with your cancellation request.
If BAMFNF believes you violated these Terms, we may immediately terminate your subscription and Services without refund. Fees due through termination remain payable.
Billing disputes must be raised within thirty (30) days of discovery unless required otherwise by law.
Transferability of Account(s) and Platform Migration Restrictions
If your plan includes sub-accounts, sub-accounts are non-transferable and cannot be assigned, shared, or moved to any other platform, software ecosystem, funnel builder, or service without express written permission from BAMFNF.
Any attempt to export, transfer, replicate, or migrate account data or content outside of the BAMFNF system — including to other HighLevel ecosystems — is prohibited.
BAMFNF will not assist with transferring or migrating sub-account data to third-party systems.
Account Assets and Intellectual Property
All templates, automations, workflows, systems, checklists, content structures, AI tools, and other materials made available (“Account Assets”) are the exclusive intellectual property of BAMFNF (or its licensors).
Even in the event of attempted migration or transition:
Account Assets remain the property of BAMFNF and are licensed only for use within the BAMFNF ecosystem;
Account Assets are non-transferable;
Any attempt to extract, duplicate, export, or reuse Account Assets outside BAMFNF is a material breach;
BAMFNF does not authorize export or reproduction of Account Assets under any circumstances.
Violations may result in suspension, termination, legal action, and damages.
Non-Downgrade Policy for Partner and Platinum Tiers
If you subscribe to Partner or Platinum tiers, you agree not to downgrade to a lower tier during your subscription term due to the immediate-access digital nature of the products and services.
Downgrade requests will not be honored and no refunds will be issued for downgrade requests. If you do not agree, do not subscribe to these tiers. Considerations will be taken on case by case bases.
Affiliate Program Terms
If you enroll in our Affiliate Program, you agree to be bound by our Affiliate Terms (as presented at enrollment or made available through the Services). By clicking acceptance and enrolling, you confirm you have read and agree to those terms.
Complaint Procedures
To help us respond quickly, complaints should include details such as the nature of the issue, where the material appears, and identifying information about the alleged violation.

False claims or frivolous proceedings may expose you to liability for damages and legal fees.
Copyright Policy (DMCA)
We reserve the right to terminate accounts for repeated copyright violations. If you believe content violates your copyright, you may submit a DMCA notice in accordance with our DMCA policy (if published) or by contacting billing@bamfnf.com.
HIPAA Compliance
If BAMFNF offers HIPAA-related services or provides a Business Associate Agreement (BAA) through its platform infrastructure provider, any HIPAA coverage and obligations will be governed by the applicable BAA and specific written agreements between you and BAMFNF.
If you believe your use case involves protected health information (PHI), you must contact us before using the Services so we can determine applicability and required documentation: billing@bamfnf.com.

Platform Account Ownership
You must provide accurate account information and keep it updated.
If you accept these Terms on behalf of a business, you represent that you have authority to bind that business, and the business is the legal owner of the account. The account owner is responsible for all activity under the account and ensuring that users comply with these Terms.
Login Credentials and Account Monitoring
You are responsible for maintaining confidentiality of login credentials and for all use of your account, authorized or not.
You agree to notify BAMFNF immediately of unauthorized access.
BAMFNF reserves the right to disable login credentials at any time in its sole discretion.
You consent to BAMFNF accessing and monitoring accounts as reasonably necessary for support, security, compliance, and enforcement of these Terms.
AI Communications Policy (Calls, Texts, Messaging)
By opting into forms, surveys, or purchases, you agree you may be contacted using automated systems, including AI-assisted calling, texting, WhatsApp messaging, direct messaging, social media messaging, and similar communication services.
Consent is not a condition of purchase.
You may opt out of SMS at any time by replying STOP.
Message frequency may vary. Message & data rates may apply.
We strive to use AI responsibly with human oversight and appropriate safeguards. Third-party AI tools may be used; you are responsible for reviewing and agreeing to applicable third-party terms where relevant.
Limitation of Liability and Disclaimer of Warranties
BAMFNF DOES NOT PROMISE, GUARANTEE, OR WARRANT BUSINESS SUCCESS, INCOME, OR SALES. Services are provided “AS IS” and “AS AVAILABLE.” You use the Services at your own risk.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for errors, interruptions, unauthorized access, malware, or losses arising from your use of the Services.
Earnings or income statements are aspirational. Testimonials and examples are not typical. Results vary. You are responsible for your decisions and due diligence.
If we recommend products or services where we may be compensated (including affiliate relationships), those recommendations reflect our belief in their value unless stated otherwise.
Dispute Resolution (Arbitration)
Any dispute arising out of or relating to your use of the Services will be resolved through binding arbitration rather than litigation, except you may bring eligible claims in small claims court on an individual basis and you may seek injunctive relief for intellectual property misuse.
Before arbitration, both parties agree to attempt informal dispute resolution. To initiate informal resolution, email billing@bamfnf.com and include your username, email address, and a description of the dispute.
Arbitration will be administered by JAMS under its applicable rules. Court review is limited.
YOU AND BAMFNF WAIVE THE RIGHT TO A JUDGE OR JURY TRIAL.

Termination

We may modify, suspend, or discontinue any portion of the Services at any time. We may update these Terms in our sole discretion. Continued use after updates constitutes acceptance of the updated Terms.
Indemnity
You agree to defend, indemnify, and hold harmless BAMFNF and its affiliates, owners, employees, and agents from claims arising from your use of the Services, your breach of these Terms, your content, or violations of law or third-party rights.
This survives termination.
Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control (e.g., acts of God, war, strikes, disasters, public health emergencies). Payment obligations for Services already rendered are not excused.
Governing Law
This Agreement is governed by the laws of the State of Arizona, without regard to conflict of laws principles. Subject to arbitration, legal actions must be filed in federal or state courts located in Maricopa County, Arizona.

Entire Agreement / No Waiver / Severability
These Terms constitute the entire agreement regarding the Services and supersede prior agreements. Failure to enforce a provision is not a waiver. If a provision is held unenforceable, remaining provisions remain in effect.
By using BAMFNF’s Services, you acknowledge that you have read and understood this Agreement and agree to be bound by it. If you do not agree, do not use the Services.
